AI Terms of Use

These AI Terms of Use are effective as of November 18, 2025.

1. Acceptance of the AI Terms of Use

These Artificial Intelligence (“AI”) Terms of Use (“Terms”) are fully incorporated into the Master Services Agreement (“MSA”) between you and StackAdapt, (collectively, the ”Agreement”) govern your use of the artificial intelligence (“AI”) products, features, services and tools (together “AI Services) that are contemplated below. These Terms form an integral part of the Agreement. All defined terms not otherwise defined herein shall have the same meaning as in the Agreement. StackAdapt may update or revise these Terms from time-to-time to accommodate the development of additional AI products or services or any statutory or regulatory requirements. You agree that you will review these Terms periodically. If you are unable to accept or comply with any version of these Terms, you should not use the AI products or services described herein.

2. Generative AI Defined

StackAdapt offers certain optional Services that incorporate “generative AI,” consisting of a category of algorithms able to generate text, images, video, sound, or other work product that appears to have been produced through human intelligence (an “Output”) in response to text prompts or content that are inputted by a human (“Inputs”).

3. Third-Party Providers

You acknowledge that StackAdapt may use technology provided by third-party service providers to provide functionality for the AI Services. StackAdapt’s generative AI Services are powered through an enterprise license with OpenAI, LLC (“OpenAI”).  Your Inputs are used to develop, train and improve the generative AI Services and its underlying large language models; provided, however, that: (i) neither OpenAI nor any other third-party does or will have access to Your Inputs or Outputs, and (ii) all Inputs and Outputs are your Confidential Information and intellectual property and shall be treated as such in accordance with these Terms.

4. StackAdapt Authorized Uses

Data generated by your use of generative AI Services is used by StackAdapt only in aggregated or de-identified form and will not disclose Your Confidential Information or Your identity, Your End Clients or any User.  In the event that you use any generative AI Services, You acknowledge that generative AI may be used in innovative ways and if You choose to use any such Services. Furthermore You are solely responsible for: (i) determining if such usage complies with laws and regulations applicable to its use of generative AI and its own policies, (ii) verifying that any Outputs do not violate the intellectual property, publicity, privacy, or other proprietary rights of StackAdapt or any third party, including removing or altering any reference or indication of the ownership rights or any third party, and (iii) the quality, accuracy, and legality of its Inputs. 

5. Prohibited Uses by You

You are prohibited from using Inputs or creating Outputs that violate StackAdapt’s Acceptable Use Policy in any manner and may not use StackAdapt’s generative AI Services to deceive Users or consumers generally by misrepresenting content that is generated through automated means as human-generated or original content. Outputs may not be used as a substitution for professional advice of any kind.  

6. Accuracy

The generative AI Services do not guarantee fully accurate, complete, reliable or suitable Outputs and StackAdapt disclaims all warranties related to the foregoing to the full extent of the law. StackAdapt disclaims any obligation to monitor or verify Your Inputs for any purpose.

7. General

If any provision of these Terms is deemed illegal, invalid or unenforceable, StackAdapt will endeavour to replace it by another provision that will, as closely as possible, reflect their original intention.
