Non-GA Services Terms of Use

From time-to-time, StackAdapt may, in its sole discretion, invite you to try a service or functionality that is clearly designated as alpha, beta, pilot, limited release, developer preview, non-production, evaluation, or by a similar description (a “Non-GA Service”), that is in development and not yet generally available. Non-GA Services are not “Services” under the Agreement and will be subject in each instance to the terms and conditions listed below and any additional terms or policies provided upon enrollment in, or during the duration of, a Non-GA Service. Further, Non-GA Services remain subject to the Agreement and the Acceptable Use Policy, but are excluded from any service-level commitment and performance warranty obligations.
(a) “As Is.” Non-GA Services are provided for evaluation and testing only, on an “as-is” and “as-available” basis, and may contain errors or be unreliable. StackAdapt disclaims all warranties, express or implied, including any regarding error-free performance, availability, accuracy, non-infringement, merchantability, fitness for a particular purpose. You assume all risks and costs associated with your use of Non-GA Services. StackAdapt has no obligation to provide support or maintenance for Non-GA Services.
(b) Fees. Non-GA Services are typically provided at no charge. Provided, however, that if fees do apply, they will be stated in ordering documentation or within the Platform for Client’s acknowledgement.
(c) Modification and Termination. StackAdapt may modify, suspend, or discontinue a Non-GA Service at any time, with or without notice, and without liability related to the foregoing.
(d) Monitoring and Feedback. You agree that StackAdapt may monitor and collect data and information about your use of the Non-GA Services in order to further develop and improve such service. You grant StackAdapt a perpetual, irrevocable, royalty-free license to use any written or verbal feedback you provide about the Non-GA Service.
(e) Intellectual Property. StackAdapt retains all rights, title, and interest in and to the Non-GA Services and related intellectual property. To the extent any Client Data is used or generated by the Non-GA Services, Client retains all rights, title, and interest in and to such Client Data in accordance with the Agreement.
(f) Duration. These Non-GA Terms apply until the Non-GA Service is made generally available or discontinued.
